Objectives of the Course

The framework of the history of general law and the formation phases of the basic concepts and institutions of modern law, the effects of Islamic and Roman Law on pre-modern legal institutions, the development of the concepts of personality, rights, and legal proceedings in modern law and the change of the legal order from the Ottoman Empire to the Republic in Turkey. To convey basic information to the student about the development of modern legal concepts and institutions and the legal reforms of the Republican period.

Course Content

The content of the Turkish Legal History course is designed to cover various topics in order to provide students with a comprehensive knowledge and understanding, Pre-Islamic Turkish Law, Islamic period Turkish Law, Ottoman Period Turkish Legal System, Tanzimat and Reform Periods Turkish Legal system and thought, Republican Era Turkish Law. Legal Reforms are classified as the Modernization Process in Turkish Law, and examining the main elements of Turkish legal thought in the light of concepts such as justice, morality and history are among the main topics of this course. Thus, it will provide them with a holistic understanding of Turkish legal history and improve their legal knowledge and analysis skills.
