Objectives of the Course

To enable those graduates who are to take part in public sector to perform their duties in line with legal criteria and principles as well as to develop a consciousness about the rights and obligations of the citizens regarding their relations with the State. Moreover, the course aims to examine the legal relations between the citizens and the State administration which is a technical extension of the executive organ due to the Constitutional principle of the “separation of powers”.

Course Content

The concept of Administrative Law and State’s Administration,Principles in Administrative Law, Duties and authorities of State’s Administration, Central Government and Auxiliary Institutions, Local Governments, Decentralized Institutions in terms of The Provision of Services, Public Goods, Public Officers, Public Services, The Concept and Practice of Law-Enforcement, Administrative acts, Administrative agreements, The Responsibility of State’s Administration, The Control over State’s Administration.

Learning Outcomes
1.Explains the basic concepts and principles of administrative law; analyzes the separate and autonomous structure of the administration, the privileges of public power and the difference of the administration from other powers.
2.Explains the principles of organization of the administration, central and decentralized administration models, constitutional and legal limits with examples.
3.Evaluates the organic and functional structure of the administration together with the criteria of being subject to administrative law and explains them through concrete examples.
4.Criticizes the relations of the administration with the legislative, executive and judicial organs; explains the duties, powers and control mechanisms of these organs comparatively.
5.Explains the legal regime of public goods, usage patterns and basic legal rules related to these goods; associates with current judicial decisions.
6.Explains the legal status of public officials, appointment, dismissal, disciplinary and personnel procedures; comments by using the relevant legislation and decisions of the Council of State.
7.Explains the types and legal characteristics of administrative contracts; analyzes the rights and obligations arising from these contracts with concrete examples.
8.Analyzes the main problems and current debates in administrative law; makes evaluation by developing legal solutions.
9.Develops the skills of critical thinking, analytical interpretation and legal opinion formation in the field of administrative law; expresses his/her opinions in accordance with professional ethical principles.
