Objectives of the Course

The aim of this course is to enable students to understand the fundamental concepts of constitutional law, the duties and powers of the basic organs of the state, fundamental rights and freedoms, the rule of law, and the principles of separation of powers; and to equip them with the knowledge and skills to evaluate public financial management, taxation authority, budgetary rights, and the principles of fiscal constitution within the framework of the Constitution of the Republic of Turkey. By the end of the course, students are expected to be able to analyze the relationship between the constitutional order and public finances and to interpret constitutional principles in terms of financial applications.

Course Content

Basic concepts and sources of constitutional law, constitution making and constitutional developments, the concept of state and constitutional state understanding, sovereignty, rule of law, democratic state and social state principles, fundamental rights and freedoms, establishment and duties of legislative, executive and judicial bodies, constitutional judiciary and constitutional audit mechanisms, constitutional foundations of local governments, public service principles, right to budget, principle of legality of tax, principle of financial power, constitutional provisions on public expenditures and public revenues and the regulations of the Constitution of the Republic of Turkey on public financial management are examined. Within the scope of the course, current constitutional court decisions and constitutional developments related to public finance are evaluated through case studies.

Learning Outcomes
1.It explains the fundamental concepts of constitutional law, the principle of constitutional supremacy, and the concept of a constitutional state.
2.It evaluates the duties, powers, and functioning of the fundamental organs of the state (legislative, executive, and judicial) within the framework of constitutional provisions.
3.Analyzes fundamental rights and freedoms, the regime of limitation of rights and the principle of the rule of law.
4.It interprets the provisions of the Constitution of the Republic of Turkey relating to public financial management, taxation authority, and budgetary rights.
5.Evaluates current constitutional and administrative events from a critical perspective in line with the principles of constitutional law.

Week 1 - Theoretical
Introduction to constitutional law: The concept of the constitution, the supremacy of the constitution, the sources and fundamental principles of constitutional law.
Week 2 - Theoretical
The concept of the state, the elements of the state, understandings of sovereignty, and the constitutional state model.
Week 3 - Theoretical
Constitutional movements and the development of the Turkish constitution (from 1876 to the 1982 Constitution)
Week 4 - Theoretical
The fundamental characteristics of the 1982 Constitution of the Republic of Türkiye and the basic principles of the Republic.
Week 5 - Theoretical
Fundamental rights and freedoms, the classification and limitation regime of rights.
Week 6 - Theoretical
Legislative body: The structure, duties, and legislative process of the Grand National Assembly of Türkiye.
Week 7 - Theoretical
Executive branch: Presidential Government System, duties and powers of the President, central administration.
Week 8 - Theoretical & Practice
General Evaluation
Week 9 - Theoretical
The judiciary, judicial independence, tenure of judges, and high judicial bodies.
Week 10 - Theoretical
Constitutional Court, constitutional jurisdiction, norm review and individual application system
Week 11 - Theoretical
Constitutional foundations of local governments, public legal personality and the principle of integrity of administration
Week 12 - Theoretical
Constitutional principles regarding finance: Legality of taxation, principle of fiscal capacity, right to budget, constitutional basis for public revenues and expenditures.
Week 13 - Theoretical
Current constitutional developments, evaluation of Constitutional Court decisions from the perspective of public finance and tax law (case studies)
Week 14 - Theoretical & Practice
General review, application examples, evaluation of current constitutional debates and preparation for the final exam
