Objectives of the Course

The objective of this course is to introduce students to the fundamental concepts, principles, and legal legislation of insurance law. Furthermore, it aims to provide theoretical and practical knowledge on the formation of insurance contracts, rights and obligations of the parties, policy production, premium and claim management processes; and to prepare students for professional life by introducing insurance types frequently encountered in the finance and insurance sectors (primarily life and non-life insurance), subrogation mechanisms, and dispute resolution methods in insurance.

Course Content

The concept of insurance, history, sources, and supervision of insurance; insurance law legislation within the framework of the Turkish Commercial Code (TCC) and the Insurance Law; definition, elements, formation, and termination of insurance contracts; rights and obligations of the parties (insurer, policyholder, insured, beneficiary); concepts of risk, premium, insurable interest, and over/under-insurance; indemnity (property, liability) insurance and life (life, accident, health) insurance; claim determination, principles of compensation payment, and the right of subrogation; the Insurance Arbitration Commission and dispute resolution methods.

Learning Outcomes
1.To be able to explain the fundamental concepts, principles, and legal legislative structure of insurance law.
2.To be able to distinguish the legal statuses, authorities, and responsibilities of intermediaries (agents and brokers) in the insurance sector.
3.To be able to evaluate the legal validity of an insurance contract by analyzing the general and special conditions in insurance policies.
4.To be able to interpret the rights, obligations, and especially the honesty/disclosure duties imposed on the parties of an insurance contract in terms of professional applications.
5.To be able to calculate the operating rules of indemnity (property and liability) insurance, and the effects of under-insurance and over-insurance situations on compensation.
6.To be able to manage the application processes and functioning of the Insurance Arbitration Commission, which is an effective out-of-court dispute resolution method in insurance.
7.To be able to analyze the legal dimensions of claim determination, compensation payment processes, and the insurer's right of subrogation after the occurrence of a risk.
8.To be able to define the legal framework of personal insurance (life, accident, health), the concept of beneficiary, and the characteristics of these insurance types.
