Objectives of the Course

Islamic law is a legal system that regulates all situations that people will encounter in their daily lives. This course aims to introduce the students to the basic concepts, sources, issues, provisions and current problems of the most common law of goods and obligations in a way to obtain a notion of law. Another aim of this course is to theoretically examine the applicability of the Islamic law of property and obligations, which is different from other legal systems today, and to discuss the results in the current context.

Course Content

The establishment of the contract, its elements and conditions, the place and parties of the contract, consent and the reasons that violate consent (mistake, cheating, ikrah, gabn, garar), the legal consequences of the contract and its termination, and muhayyerliks, which are the subjects of the law of property and the law of obligations, are discussed in this course. Other types of sales contracts such as facit bey', sarf, trampa, selem, istısna' are also examined in this context. Riba and current discussions are important topics of the course. In addition, the contract of icare and its elements, the contract of pledge and its establishment, grant and karz transactions and partnerships in Islamic law are other topics that make up the content of this course.

3.Learning the historical development course of Islamic law of property and obligations and recognizing the sources of Islamic law of property and obligations
4.Learning the basic concepts, issues and debates of Islamic economics and thinking about the relationship between law-economics-society
5.Acquiring the ability to compare Islamic economic concepts with modern economic concepts and to establish connections between them.
