The aim of this course is to provide practical skills in the actuarial and technical calculation methods required for disputes arising from labor, social security, enforcement and bankruptcy, family, condominium, consumer, obligations, commercial, and inheritance law, as well as contracts for work and services. It aims to equip students with the competence to calculate items such as pecuniary compensation, claims/receivables, shares, alimony, and progress payments across different branches accurately, in compliance with relevant legal regulations, and at a reportable standard.
It covers technical and actuarial calculations for disputes arising from labor, social security, obligations, family, inheritance, commercial, consumer, condominium, and enforcement law, as well as contracts for work and services. Students learn to calculate core items such as compensations, labor claims, bodily and material damages, loss of support, liquidation of the matrimonial property regime, inheritance distribution, enforcement calculations, and progress payments in compliance with current legal regulations and Supreme Court of Appeals jurisprudence.
| 1. | Apply Basic Actuarial Calculations: Able to calculate material damages and loss of support compensations arising from torts or accidents in accordance with legal standards, using current life/mortality tables (e.g., TRH-2010) and interest/discount rates. |
| 2. | Determine Labor and Social Security Claims: Able to formulate compensation (severance, notice, etc.) and wage (overtime, national/public holidays) items, statutory deductions, and Social Security Institution (SSI) recourse calculations within the scope of labor legislation, in compliance with Supreme Court of Appeals jurisprudence. |
| 3. | Determine Shares and Values in Private Law Disputes: Able to allocate items such as the liquidation of the matrimonial property regime, inheritance distribution, alimony updates, and loan/dues debts according to statutory rates in disputes arising from family, inheritance, consumer, and condominium legislation. |
| 4. | Analyze Commercial, Enforcement, and Contractual Receivables: Able to prepare cover calculations and the order of creditors for enforcement files, apply appropriate interest types (statutory, commercial default, advance interest) according to the dispute type, and determine progress payments arising from contracts for work and services. |
| 5. | Manage Legal Reporting and Justification Processes: Able to report all technical and mathematical calculations in a clear expert witness/expert opinion format suitable for judicial review, by associating them with legal grounds and precedent Supreme Court of Appeals decisions. |
