Objectives of the Course

The main objective of this course is to provide students with theoretical and practical knowledge regarding the place of intellectual and artistic works and industrial property rights (trademarks, patents, designs, utility models, etc.) in national and international legislation, their registration and protection methods, licensing/transfer procedures, and the legal remedies to be applied in case of right infringement.

Course Content

This course covers the emergence, registration processes, protection, and transfer of intellectual and industrial property rights such as intellectual and artistic works (copyrights), trademarks, patents, utility models, designs, and geographical indications. Students learn about ownership, licensing agreements, right infringements, invalidation/cancellation actions, and the impacts of current developments like digitalization decisions.

Learning Outcomes
1.Define the basic concepts related to intellectual and industrial property law within the framework of national and international legislation.
2.Distinguish between economic and moral rights on intellectual and artistic works, and determine the legal and criminal remedies to be applied in copyright infringements.
3.Analyze the registration requirements, scope of protection, and absolute/relative grounds for refusal for trademarks, patents, utility models, and design rights.
4.Evaluate infringement, invalidation, and cancellation claims regarding industrial property rights in light of Supreme Court of Appeals jurisprudence and TURKPATENT practices.
5.Interpret contract processes such as licensing, transfer, and pledge subject to intellectual and industrial rights in accordance with legal validity conditions.
