The aim of this course is to provide students with a comprehensive understanding of the legal foundations, constitutional framework, and legislation governing the local government system in Türkiye. The course enables students to examine the establishment, organizational structure, duties, powers, and responsibilities of municipalities, metropolitan municipalities, special provincial administrations, and local government unions. It also aims to develop students' ability to analyze legislation concerning local public service delivery, administrative tutelage, financial structure, auditing mechanisms, and recent legal developments, and to apply this knowledge effectively in professional practice.
This course covers the concept of local government and the constitutional foundations of the local government system in Türkiye. It examines the principal legislation governing local administrations, including the Municipality Law (No. 5393), Metropolitan Municipality Law (No. 5216), Special Provincial Administration Law (No. 5302), and Law on Local Government Unions (No. 5355). The course also addresses the establishment, organizational structure, duties, powers, and responsibilities of local governments; decision-making processes; administrative tutelage; financial structure, budgeting, and auditing; legal principles of local public service delivery; transparency, accountability, ethics, and participatory governance in local administrations. In addition, the European Charter of Local Self-Government, recent legislative amendments, and significant judicial decisions are examined.
