Objectives of the Course

The aim of this course is to provide students with a comprehensive understanding of the legal foundations, constitutional framework, and legislation governing the local government system in Türkiye. The course enables students to examine the establishment, organizational structure, duties, powers, and responsibilities of municipalities, metropolitan municipalities, special provincial administrations, and local government unions. It also aims to develop students' ability to analyze legislation concerning local public service delivery, administrative tutelage, financial structure, auditing mechanisms, and recent legal developments, and to apply this knowledge effectively in professional practice.

Course Content

This course covers the concept of local government and the constitutional foundations of the local government system in Türkiye. It examines the principal legislation governing local administrations, including the Municipality Law (No. 5393), Metropolitan Municipality Law (No. 5216), Special Provincial Administration Law (No. 5302), and Law on Local Government Unions (No. 5355). The course also addresses the establishment, organizational structure, duties, powers, and responsibilities of local governments; decision-making processes; administrative tutelage; financial structure, budgeting, and auditing; legal principles of local public service delivery; transparency, accountability, ethics, and participatory governance in local administrations. In addition, the European Charter of Local Self-Government, recent legislative amendments, and significant judicial decisions are examined.

1.Explains the constitutional and legal foundations, fundamental concepts, and administrative structure of the local government system in Türkiye.
2.Interprets the principal legislation governing local governments, including the Municipality Law, Metropolitan Municipality Law, Special Provincial Administration Law, and Law on Local Government Unions.
3.Analyzes the organizational structure, duties, powers, and responsibilities of local governments within the framework of the relevant legislation.
4.Evaluates decision-making, public service delivery, financial management, and auditing processes in local governments.
5.Evaluates legal issues related to local government legislation by considering current legislation and judicial decisions and develops solution proposals.
6.Critically evaluates the legal framework of transparency, accountability, ethics, participation, and good governance principles in local governments.

Week 1 - Theoretical
Introduction to local government: concepts, principles, and the development of the local government system in Türkiye. Constitutional foundations and the place of local governments within the administrative structure.
Week 2 - Theoretical
Fundamental legislation governing local governments. Constitutional provisions and the principal legal framework related to local administrations.
Week 3 - Theoretical
Municipality Law No. 5393: establishment, duties, powers, and responsibilities of municipalities.
Week 4 - Theoretical
Municipal bodies: duties and powers of the mayor, municipal council, and municipal executive committee.
Week 5 - Theoretical
Metropolitan Municipality Law No. 5216: metropolitan municipality system, distribution of duties, powers, and responsibilities.
Week 6 - Theoretical
Special Provincial Administration Law No. 5302 and Law No. 5355 on Local Government Unions: legal framework of special provincial administrations and local government unions.
