Objectives of the Course

The aim of this course is to enable students to learn the main legislation topics encountered in the real estate sector and evaluate real estate transactions within a legal framework.

Course Content

The course examines land registry legislation, real property ownership, sale and transfer procedures, lease legislation, condominium ownership, zoning legislation, real estate trade, authorization certificates, consumer rights, and professional responsibilities.

Weekly Detailed Course Contents
Week 1 - Theoretical
Introduction to Real Estate Legislation: The concepts of real estate, immovable property, legislation, laws, regulations, and the importance of legal knowledge in the real estate sector are explained.
Week 2 - Theoretical
Main Sources of Real Estate Law: The Turkish Civil Code, Land Registry Law, Condominium Law, Zoning Law, Code of Obligations, and related regulations are introduced in general terms.
Week 3 - Theoretical
Real Property Ownership and Real Rights: Ownership rights, shared ownership, joint ownership, usufruct, easement, construction right, and limited real rights on immovable properties are explained.
Week 4 - Theoretical
Land Registry Legislation and Transactions: Land registry records, registration, cancellation, annotations, declarations, encumbrances, and key issues in title deed transactions are discussed.
Week 5 - Theoretical
Sale, Transfer, and Official Deed Processes: Parties in real estate sales, official deeds, title deed fees, representation, power of attorney, and legal responsibilities in the sale process are explained.
Week 6 - Theoretical
Lease Legislation and Lease Agreements: Residential and commercial leases, elements of lease agreements, rent, deposits, eviction, and the rights of parties are discussed at a basic level.
Week 7 - Practice
Real Estate Legislation Case Evaluation: Students are asked to interpret basic legal rules through a sample sale, lease, or title deed transaction.
Week 8 - Theoretical
Condominium Ownership and Construction Servitude Legislation: Condominium ownership, construction servitude, independent units, land share, common areas, management plans, and apartment-site management are explained.
Week 9 - Theoretical
Zoning Legislation and Construction Rules: Zoning plans, zoning status, building permits, occupancy permits, illegal structures, and the effects of construction conditions on real estate transactions are explained.
Week 10 - Theoretical
Land, Plot, and Agricultural Property Legislation: The distinction between land and plots, agricultural lands, jointly owned properties, subdivision, consolidation, road dedication, and real estate development processes are discussed.
Week 11 - Theoretical
Property Tax, Fees, and Financial Obligations: Property tax, title deed fees, capital gains, rental income, declaration obligations, and financial responsibilities in real estate transactions are explained.
Week 12 - Theoretical
Real Estate Trade Legislation and Authorization Certificate: Authorization certificates, professional competence, authorization agreements, property showing forms, service fees, and professional responsibilities in real estate businesses are discussed.
Week 13 - Theoretical
Consumer Rights, Advertising, and Professional Liability: Misleading listings, unfair commercial practices, consumer rights, confidentiality, accurate information, and the legal responsibility of real estate agents are explained.
Week 14 - Theoretical
General Review and Practical Legislation Analysis: The semester topics are reviewed; students are asked to evaluate a sample real estate transaction in terms of land registry, zoning, lease, tax, and professional legislation.
