Objectives of the Course

The aim of this course is to enable students to learn obligation relationships, contracts, and law of obligations topics frequently encountered in the real estate sector at a basic level.

Course Content

The course covers obligation relationships, contracts, torts, unjust enrichment, formation of contracts, performance of obligations, breach of obligations, sale contracts, lease contracts, agency, brokerage, commission, and compensation liability.

Weekly Detailed Course Contents
Week 1 - Theoretical
Introduction to the Law of Obligations: The concepts of law of obligations, obligation relationship, creditor, debtor, performance, and liability are explained.
Week 2 - Theoretical
Sources of Obligations: The concepts of contract, tort, and unjust enrichment are discussed at a basic level.
Week 3 - Theoretical
Concept and Formation of Contracts: Declaration of intent, offer, acceptance, freedom of contract, form requirements, and the importance of contracts in real estate transactions are explained.
Week 4 - Theoretical
Validity of Contracts and Defects of Consent: Mistake, fraud, duress, legal capacity, illegality, and immorality affecting contract validity are explained.
Week 5 - Theoretical
Performance of Obligations: Fulfillment of obligations, place of performance, time of performance, monetary obligations, default, and payment duties in real estate transactions are discussed.
Week 6 - Theoretical
Non-Performance and Liability: Breach of obligation, delay, defective performance, damage, compensation, and the responsibilities of parties are explained.
Week 7 - Practice
Contract Case Evaluation: Students are asked to evaluate the rights and obligations of parties through a sample sale, lease, or commission contract.
Week 8 - Theoretical
Sale Contract and Real Estate Sale: The parties to a sale contract, obligations of the seller and buyer, official form in real estate sales, and title deed transfer process are discussed.
Week 9 - Theoretical
Lease Contract: Residential and workplace leases, rent, deposits, obligations of tenant and landlord, eviction, and termination of lease relationships are explained.
Week 10 - Theoretical
Agency Contract and Representation: Agency relationships, authority of representation, power of attorney, representation in real estate transactions, and issues requiring attention are explained.
Week 11 - Theoretical
Brokerage, Commission, and Real Estate Consultancy Relationship: Brokerage and commission relationships, the real estate agent’s right to service fees, bringing parties together, and contractual liability are examined.
Week 12 - Theoretical
Tort and Compensation Liability: Unlawful acts, fault, damage, causation, material and moral compensation, and examples of liability in the real estate sector are discussed.
Week 13 - Theoretical
Limitation Periods, Penalty Clauses, and Security in Contracts: Limitation periods, penalty clauses, deposits, withdrawal money, guarantees, suretyship, and risk management in real estate contracts are explained.
Week 14 - Theoretical
General Review and Practical Law of Obligations Scenario: The semester topics are reviewed; students are asked to evaluate a sample real estate sale, lease, or commission process from the perspective of the law of obligations.
