Objectives of the Course

The aim of this course is to analyze, in detail and from a comparative perspective, the fundamental elements, duties, and powers of the legislative, executive, and judicial branches as defined by the 1982 Constitution; to explain the relationship between the legislative and executive branches within the framework of the principle of separation of powers; and to elucidate the nature of the system of government; to examine forms of extraordinary governance in Turkey in a comparative manner throughout history; and to explain the fundamental principles of law within the framework of constitutional adjudication, as well as the structure, duties, and types of review exercised by the Constitutional Court.

Course Content

The substance of the concepts of the state, law, and the constitution; social dynamics and the emergence of constitutional regimes; the drafting and amendment of constitutions; the organs of the state; the legislative, executive, and judicial branches; the rationale behind the principles of the separation and unity of powers; the characteristics of the Republic of Turkey’s system of government, which is based on the principle of the separation of powers; relations between the legislative and executive branches; forms of emergency governance; the organs, structure, duties, and types of oversight of constitutional courts.

1.It defines the fundamental bodies of the legislative branch, as well as their powers and duties.
2.It defines the fundamental organs of the executive branch, its procedures, powers, and duties.
3.It explains the structure and functioning of the institutions within the legislative and executive branches.
4.By defining the relationship between the legislative and executive branches in terms of checks and balances, it highlights the nature of the system of government
5.It examines forms of extraordinary governance and the fundamental rights and freedoms inherent in these forms of governance.
6.It discusses the process by which constitutional amendments are made and the impact of the articles that have been amended to date on the state and government systems.
7.Within the framework of constitutional adjudication, this section explains the duties and powers of the Constitutional Court, its institutional structure, the characteristics of the decisions it renders, and the procedures and principles governing the various types of review.

Constitutional Amendment: Form, Procedure, and Examples.
Week 4 - Theoretical
Executive Branch: The Executive Branch in Organic and Functional Terms, Structure of the Executive Branch, Comparison of the Old and New Systems
Week 5 - Theoretical
Types of Administrative Acts: Unilateral and Regulatory Acts; the Principles of Legality and Non-Contradiction with the Law.
Week 6 - Theoretical
Government Systems: Characteristics of Presidential, Parliamentary, and Semi-Presidential Systems
Week 7 - Theoretical
The Government System in Turkey: Comparisons of the government systems before 2014, between 2014 and 2018, and after 2018; the trend toward strengthening the executive branch

The Executive Branch Under Constitutional Provisions: The President, eligibility requirements, qualifications for office, election procedures, assumption of office, and termination of office, impartiality.

Judicial Independence and Constitutional Review: Supreme courts; fundamental principles governing the judiciary; the structure, duties, and powers of the Council of Judges and Prosecutors; the structure of the Constitutional Court.
Week 14 - Theoretical
Constitutional Jurisprudence: The scope of the Constitutional Court’s review, the duties and powers of the Constitutional Court, abstract and concrete review of norms, individual applications, and the characteristics of Constitutional Court decisions.
